These terms apply to estimating, takeoff and detailing work carried out by Pro Steel Solutions Ltd. They are not a substitute for legal advice and you should have your own solicitor read them before you rely on them.
1. What we do
We measure quantities and prepare estimates from the information you supply. Our work supports your commercial decision. It is not a design, it does not discharge any designer’s duty, and it must not be used as if it were engineering advice.
2. Fees
Fees are quoted in writing before work starts and do not change unless the scope changes and you agree in writing. A figure produced by the pricing wizard on this website is indicative; the written fee is the contract. Fees are held for the period stated on the quote.
3. Information you supply
We measure what we are given. Where information is missing, contradictory or illegible we record an assumption and flag it in the clarifications; we do not guess silently. We are not liable for an error that follows from information you supplied being wrong, incomplete or superseded, unless we ought reasonably to have spotted it.
4. Checking our work
You must review our deliverables and tell us about any error within 14 days of delivery. We will correct genuine errors in our measurement free of charge. After 14 days, or once you have submitted a tender based on our work, corrections are chargeable.
5. Liability
Our total liability for any one job, however it arises, in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of the fee paid for that job or £5,000.
We are not liable for loss of profit, loss of contract, loss of opportunity, loss of anticipated savings, or any indirect or consequential loss, including the loss of a tender.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
We carry professional indemnity insurance. Details on request.
6. Payment
Invoices are payable within 14 days of delivery by bank transfer. We do not take card payments. We may charge statutory interest and a fixed sum under the Late Payment of Commercial Debts (Interest) Act 1998 on anything overdue.
7. Your information
Your drawings are held in a private, access-controlled store, are never shared outside Pro Steel Solutions, and are deleted automatically after the period set out in our privacy policy. You are notified before deletion. We will sign your NDA on request.
You confirm that you are entitled to pass us the information you send and that doing so does not breach anyone else’s copyright or confidence.
8. Intellectual property
Copyright in the schedules, models and documents we produce passes to you on payment in full. Until then we licence them to you for the purpose of the tender only. Our underlying methods, templates and rate data remain ours.
9. Confidentiality
We treat your pricing as confidential and do not discuss one client’s rates with another. If you are bidding against another of our clients, tell us and we will tell you honestly whether we can act.
10. Cancellation
You may cancel at any time. You pay for the hours worked up to the point we are told, charged at our standard hourly rate.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
